Terms of Service

1. General provisions

These Terms of Service set out the rules for using the vendorsnear.com website (the “Service”).
The Service is operated by Giraffe Creative LLC (the “Administrator”).
The Service enables:
  • Users to submit requests for vendor services (e.g., weddings, events, parties),
  • Vendors (the “Vendors”, “Businesses”) to receive requests, maintain a profile, and use optional additional features.
Using the Service means you accept these Terms.

2. Scope of services

The Service provides Vendors with the ability to:
  • create a free profile on the Service,
  • receive requests submitted by Users,
  • present a professional profile, including a contact/request form,
  • purchase paid features, including access to full User contact details for a request (lead model), adding a website link, enhanced profile features, or priority placement.
Users can submit a request for Vendors in a selected location and/or category at no cost.
The Administrator does not participate in further conversations or agreements between the User and the Vendor.

3. Vendor registration and verification

Vendor registration is voluntary.
During registration, Vendors may be required to provide:
  • name and surname,
  • license/certification number (if applicable),
  • contact details,
  • business/registration details.
To ensure trust and accuracy, the Administrator may verify Vendors using provided information and/or publicly available sources.
The Administrator may refuse activation or remove an account if data is incomplete, false, or inconsistent with verification requirements.

4. Vendor profiles and additional features

A Vendor’s basic profile is free and may include: business details, a description of services, location, and basic contact information.
A Vendor profile may include a contact/request form that allows Users to submit requests.
Depending on the selected plan (free or paid), a Vendor may gain access to additional features such as:
  • the ability to respond to requests,
  • the ability to add a website link,
  • priority placement in listings,
  • advanced profile presentation options.
The Administrator reserves the right to change plan features; current details are always published in the Service.

5. User requests

Users may submit requests via forms available in the Service.
Vendors may receive requests matched by:
  • location,
  • category/service type,
  • the Vendor’s plan or eligibility settings.
To access full User contact details, a Vendor may be required to pay a one-time fee for a request or use paid Service features (e.g., lead credits or subscription plans).
The Administrator does not guarantee the number or quality of received requests.

6. Reviews and ratings

Both Users and Vendors may submit reviews and ratings about their experience.
Reviews may be collected by the Administrator to:
  • improve the Service,
  • analyze the quality of interactions between Vendors and Users,
  • publish reviews in the Service if they are lawful and comply with these Terms.
The Administrator may moderate, edit, or remove reviews if they:
  • contain unlawful content,
  • infringe personal rights,
  • are advertising, spam, profanity, or include confidential information,
  • are clearly false or misleading.

7. Rules for using the Service

It is prohibited to:
  • provide false information,
  • attempt to bypass paid plan requirements,
  • use User data unlawfully or contrary to these Terms,
  • publish content that infringes third-party rights.
The Administrator may temporarily or permanently restrict account access in case of a violation of these Terms.

8. Payments and invoices

The Service may offer one-time fees for requests and paid add-on services, including subscription plans. Current pricing and payment rules are available in the Service.
Payments may be made:
  • as one-time purchases,
  • as recurring subscriptions.
Information about prices, available plans, and their scope is available within the Service.
After payment, the Vendor receives access to paid features for the period specified in the offer.
Upon request, the Administrator may issue an invoice for completed payments.
Failure to pay may result in automatic limitation of features or suspension of access to a paid plan.
Refunds are available only in cases required by applicable law or described in the relevant offer terms.

9. Liability

The Administrator is not a party to agreements concluded between a User and a Vendor.
The Administrator is not responsible for:
  • the quality of Vendor services,
  • the accuracy of information submitted by Users,
  • a Vendor’s failure to respond to a request,
  • damages resulting from contact or cooperation between the parties.
The Service is a technical platform providing tools for exchanging information.

10. Personal data

User and Vendor data is processed in accordance with the GDPR and other applicable laws.
Details are described in the Privacy Policy available on the Service.

11. Account deletion

A Vendor may request deletion of their account at any time.
The Administrator may delete or block an account in case of:
  • violations of these Terms,
  • providing false information,
  • reports of abuse.
After account deletion, public data is removed in accordance with applicable laws.

12. Changes to the Terms

The Administrator may make changes to these Terms.
Vendors will be notified about changes by email or via a notice in the Service.
Continued use of the Service means acceptance of the changes.

13. Final provisions

These Terms apply from the time they are published.
In matters not covered by these Terms, the laws of the Republic of Poland apply.
Any disputes will be resolved by the competent common court.
